ECR HOLIDAYS is a company that provides villas and their individual rooms to guests, mainly for residential purposes to guest, under the brand name “ECR HOLIDAYS”. The below Terms and Conditions are applicable to all the guests or customers who make bookings any of the Properties (defined below) or their individual rooms through our website, our mobile application, third party websites or third party applications or through any travel agents/third parties/ advertisements/ referrals etc. (collectively “Booking Channels”). All guests should ensure to read and understand all the Terms and Conditions stated on our website before using this website and making a booking through any of the Booking Channels. These Terms and Conditions shall be applicable to guests making a booking through any of the Booking Channels. If you are not agreeable to any of these Terms and Conditions of Use, please do not use this website/Booking Channels and do not make a Booking for any of the Properties. These Terms and Conditions are subject to change and ECR HOLIDAYS may at any time, without prior notice to you/ any guest, revise them and any other information contained in this website and/or any Booking Channel by updating these Terms and Conditions. Please note that the restated Terms and Conditions shall be effective immediately upon posting. ECR HOLIDAYS may also make improvements or changes in the services provided by it as described in this website/ Booking Channels at any time without notice. Therefore, you are advised to regularly check for any amendments or updates to these Terms and Conditions. If the changes are not agreeable to you, you must stop using the website. Your continuous use of this website will imply your acceptance of the changed terms.
Except where additional terms and conditions are provided, these Terms and Conditions supersede all previous representations, understandings or agreements and shall prevail notwithstanding any variance with any other terms of any order placed or service provided by ECR HOLIDAYS.
For the purpose of online as well as offline bookings made through our platform, the terms used in these Terms and Conditions have the following meaning:
(a) “Property/Properties” shall mean and include villas and their individual rooms available for booking on any of the Booking Channels.
(b) “Guest/Guests” refers to any individuals/ companies or other entities who express interest to make a booking in respect of any of the Properties through any Booking Channels. Guests may be referred to as you, your in given context.
(c) “Booking” means a reservation made by any Guest in respect of any of the Properties for the purpose of stay.
(d) "Check-In" is the scheduled date and time on or before which the Guests shall be liable to comply with all the check-in formalities as required by ECR HOLIDAYS and after completion of such formalities the Guest shall be entitled to start using the concerned property.
(e) "Check-Out” is the scheduled date and time on which the Guest will have to vacate the concerned Property after completion of all the check-out formalities as required by ECR HOLIDAYS.
(f) “Booking Period” is the period between which the scheduled Check-In starts and the scheduled Check-Out ends
(g) “Booking Amount” shall mean the total amount payable by the Guest to ECR HOLIDAYS for confirmation of the Booking through the registered mode of payment, as may be intimated by ECR HOLIDAYS to the Guest.
(h) “Booking Confirmation” shall mean the email/communication shared by ECR HOLIDAYS with the Guests upon receipt of the Advance (defined below) and shall comprise of all the details of the Booking, Terms & Conditions governing the Booking, name and total number of Guests, Check-In and Check- Out details, name of Property, number of rooms at the Property, the Booking Amount payable and Security Deposit amount payable and specified due dates by which they are required to be paid/deposited. ECR HOLIDAYS shall not be liable to serve a Booking unless the entire Booking Amount is paid by the Guest/Guests to ECR HOLIDAYS through the registered mode of payment intimated by ECR HOLIDAYS to the Guest as stated herein, even though the Booking Confirmation may have been sent to the Guest. The Booking Confirmation along with proof of payment of the entire Booking Amount shall be required to be produced by Guests at the Property at the time of Check-In.
(i) "Advance" is the non-refundable amount required to be deposited by Guests with ECR HOLIDAYS as deposit for putting a Booking on Hold (as stated hereinbelow) in respect of a Property.
(j) "Security Deposit" is the amount required to be deposited by Guests on a case to case basis with ECR HOLIDAYS. The Security Deposit shall be utilized by ECR HOLIDAYS for any damages caused by the Guests/their pets to the Property and/or items/furniture therein and/or for recovery of any other charges levied by ECR HOLIDAYS on Guests.
(k) “Peak Days” includes long weekends, festive dates including but not limited to Diwali, New Years, Christmas etc.
ECR HOLIDAYS shall be entitled to cancel a Booking at anytime without giving any prior intimation to the Guest/Guests. To see our updated Cancellation Policy, please visit Cancellation Policy.
Guests shall understand and agree that making payment of the Advance and/or Security Deposit (depending on case to case basis as decided by ECR HOLIDAYS) or Booking Confirmation shall clearly construe and mean that Guests have read and unconditionally accepted all the details of the Booking and abide by them.
The issuance of the Booking Confirmation does not ensure that Booking is confirmed.
It is clarified that ECR HOLIDAYS shall not be liable to serve a Booking unless the entire Booking Amount is paid by the Guest/Guests to ECR HOLIDAYS through the registered mode of payment intimated by ECR HOLIDAYS to the Guest/ Guests even though the Booking Confirmation may have been sent to the Guest. The Booking Confirmation shall stand canceled, withdrawn and null and void, if the entire Booking Amount is not received by ECR HOLIDAYS by specified due dates.
In the event a Booking is made from any third party websites or third party applications or through any travel agents/third parties/ advertisements/ referrals, the Guest/Guests should confirm the Booking with us. ECR HOLIDAYS shall not be liable to serve a Booking unless the entire Booking Amount is received by ECR HOLIDAYS through the registered mode of payment, even though the Booking Confirmation may have been sent to the Guest by such third party websites or third party applications or through any travel agents/third parties/ advertisements/ referrals and/or ECR HOLIDAYS. Further, in the event a Booking is made from any third party websites or third party applications or through any travel agents/third parties/ advertisements/ referrals, the terms and conditions of such third party shall also be applicable to the Guest/Guest and the Booking, in addition to the terms and conditions laid down by us in respect to the Booking. In the event any term/condition of such third party is inconsistent with the Terms and Conditions set out herein or intimated to the Guest/Guests by ECR HOLIDAYS, the Terms and Conditions of ECR HOLIDAYS shall prevail.
a. Guests shall understand and agree that Property booked by the Guests is a residential property with other persons living around. It is imperative that the conduct of the Guests shall in no way disturb the tranquility, peace and modesty of the neighbors.
b. The Property booked by the Guests shall be used only for the purpose of stay and not for any other purpose.
c. The Guests shall not cause any nuisance to the property of the neighbors.
d. In order to avoid disturbance to the neighbors the Guest shall ensure that no loud music is played around poolside, garden, compound, balconies or terraces etc. or any outdoor area that would cause disturbance to neighbors or cause any kind of nuisance.
e. The Guests shall not use Property for committing or conducting any unlawful act or immoral activity, ECR HOLIDAYS and any of the representatives, employees, relatives or agents of the ECR HOLIDAYS shall in no way be responsible or liable for such acts on behalf of the Guests.
g. The Guests shall not possess or consume any prohibited drugs or organize any rave parties in or around Property. Breach of this condition will result in immediate lodging of a Police Complaint by ECR HOLIDAYS against the Guests.
The guest must understand and agree that ECR HOLIDAYS with all the reasonable efforts provides and posts the realistic pictures of the Property. In case the description or depiction of the Property is materially inaccurate with respect to size of the Property as per the Guests, ECR HOLIDAYS shall not be held responsible or liable.
During the Booking, if the amenities like decks, pools, hot tubs, bathrooms (toilet/shower/bathtub), kitchen (sink/stove/refrigerator or major other appliances), and electrical, heating or air condition systems are not present as displayed in the pictures on our Booking Channels or are not functioning properly or if the Guests are not satisfied with cleanliness including but not limited to clean bedding, towels etc. or if the Guests come across issues related to insects, unpleasant odor, or any deficiency of services and amenities like electricity, gas, water, swimming pool, wifi, medical box, electronic appliances etc. at the Property, Guests shall bring the same to the notice of ECR HOLIDAYS in writing or via telephone or whatsapp and provide us with information (including photographs or other evidence) about the same within 12hours from the Check In time. ECR HOLIDAYS shall make its best efforts to resolve these issues but it shall not be held responsible or liable if the same are not resolved in due time. Guests understand that ECR HOLIDAYS shall not in any way be liable to refund or compensate the Guests in case the issues are not resolved. The decision of ECR HOLIDAYS in all such matters will be final.
You understand and agree that any such issue must not have been directly or indirectly caused due to your action, omission or negligence.
In case the Property is occupied by some other visitors at the Check –In time of a particular Guest, ECR HOLIDAYS shall use their reasonable efforts to find and book you another Property which is reasonably comparable to the Property described in your original Booking in terms of size, rooms, features and quality. Pets may or may not be allowed on the Properties at the discretion of StayVista. Such information will be set out in the Booking Confirmation issued to Guests. StayVista may, at its discretion, charge a non-refundable Pet Fee. If the Guests/their visitors, bring pets to Property without StayVista's prior written approval or if the Guests bring pets other than the one whose specific approval is granted, such pets shall not be allowed to enter the Property and if Guests have already Checked-In, they may be evicted by StayVista from the Property.
Pets, when allowed by StayVista, must be kept on the Property and should always be in company and control of Guests. Guests shall be solely and entirely responsible to ensure that pets do not soil, spoil or damage the Property and/or the items/furniture therein. The Guests shall be responsible for ensuring that their pets do not create any nuisance to the neighbors or any other people around the Property.
